Terms and Conditions

Last updated: October 2026

1. Scope and seller

These terms apply to every order of Template Kuli incl. setup made through this website. The seller is:

Joshua Kern
Montanusstraße 1
51065 Köln
Germany
Phone: +49 176 70917543
Email: hi@kernjosh.com

2. What you buy

You buy a portfolio website based on my Template Kuli, set up for you. The pages, features and limits are described on the template page at the time of your order. That description is part of the contract.

3. Your accounts and third parties

The website runs on accounts in your name (for example Cloudflare and Sanity). Their terms and prices apply between you and them. You pay for your domain yourself (around 10 € per year). I have no influence on these services, their availability or their prices. If a provider changes its plans or prices after the site is set up, that is not a defect of my work.

4. Ordering and contract

To order, click "Purchase" on the template page, enter your details and payment on Stripe's page, tick the box asking me to start right away, and click "Pay". Until then you can change every entry or go back, and nothing is ordered or charged.

The template page is not a binding offer. By clicking "Pay" you make a binding offer. I accept it by sending you an order confirmation by email, at the latest by collecting your payment. That is when the contract is concluded. If the payment fails or you cancel it, no contract is concluded.

I store the contract text (your order details and these terms). It is not available to you online after your order, but you get it by email with your order confirmation. You can save or print these terms on this page at any time.

The contract can only be concluded in English.

5. Prices and payment

The total price is 400 € once, incl. VAT where applicable. There are no shipping or other extra costs from me and no subscription. You pay when you order, via Stripe, by credit or debit card (also through Apple Pay or Google Pay), PayPal or Klarna. If you pay with PayPal or Klarna, their terms also apply. You get an invoice by email.

6. Timeline and your part

I get in touch within two working days after your payment. Once your accounts are set up and you have sent me what I need (access to the accounts, your domain details), I build your website within one week. After you have filled in your content and tell me you're ready, the site goes live within two working days.

You are responsible for setting up your accounts and for your content. While I'm waiting for you, my deadlines are paused.

If I'm waiting for you, I can give you two weeks by email to send me what I need and tell you that I will end the contract otherwise. If nothing comes within these two weeks, the contract ends. I then keep 20 % of the price if I haven't started building your website yet, or 80 % once it's built, and refund the rest. If you can show that the work I did is worth less, I only keep that amount.

Once the website is set up on your accounts and you have access, I'll tell you by email. From then on it counts as provided to you.

7. Your content

Your photos and texts stay yours. You make sure you have the rights to everything you publish on the site, and that your site has a correct imprint and privacy policy.

8. Rights of use

The template, its code, the drawings and the font are my work. With full payment you get a non-exclusive right, unlimited in time, to use the website for your own portfolio on one domain. You may change all content in the editor, move the site to another domain, and change or extend the code for your own website, or have someone else do it for you. You may transfer this right together with the website, for example when you sell your business.

You may not sell, give away or license the template, the code, the drawings or the font on their own, use them for other websites, or take them out of the website for other uses.

9. Right of withdrawal

Consumers have a right of withdrawal. See the withdrawal policy. You can withdraw online on the withdrawal page.

With the box on the payment page you ask me to start setting up your website right away. Your right of withdrawal for the template then ends once I start. If you withdraw from the setup, you pay for the part I have already done.

10. Defects and complaints

If my work has a defect or you want to complain, email me at hi@kernjosh.com and I'll fix it. Your statutory rights apply, including the statutory warranty rights for digital content and digital services.

11. Liability

If I cause damage on purpose or through gross negligence, or if someone gets hurt, I'm fully liable. The same goes for defects I hid, guarantees I gave and the Product Liability Act. In all other cases I'm only liable for the typical damage that could be foreseen when you ordered. All of this also applies to people I use to perform the contract.
